Rokita Moves to Dismiss Gary’s Gun Lawsuit

Indiana Attorney General Todd Rokita is calling for the dismissal of a 25-year-old lawsuit filed by the city of Gary against gun manufacturers and sellers. Rokita contends that the lawsuit represents a misapplication of the courts to challenge the rights of law-abiding citizens under the Second Amendment, asserting that only the state legislature can pursue such actions.

Originally launched in August 1999, the lawsuit targets multiple firearm manufacturers and retailers over allegations that their products contributed to criminal activity in the city. Rokita’s recent filing highlights a 2024 law granting the state exclusive authority to regulate firearm-related lawsuits, emphasizing that the local government cannot exceed powers expressly restricted by the legislature.
