Indiana Court Rules Second Amendment Excludes Machine Guns

The Indiana Court of Appeals has ruled that the Second Amendment does not extend to machine guns, affirming the conviction of a man arrested for possessing a modified Glock 22. Jacob McGee, who was 18 at the time of his arrest in 2023, was found guilty of felony machine gun possession after officers discovered his firearm was equipped with a device that allowed it to fire automatically.

The court’s ruling, which reflects a consensus among many federal courts, states that the Second Amendment’s protections are “not unlimited” and do not cover “dangerous and unusual weapons.” Judge Nancy Vaidik’s opinion also noted that McGee was aware that the conversion switch enhanced his firearm’s capability, contradicting his appeal that he was unaware it turned his gun into a machine gun. This decision highlights ongoing debates over gun rights and regulations in the United States.
