Montana Lawmakers Weigh Ban on Local Red Flag Laws

Montana legislators are currently considering House Bill 809, which would prohibit local governments from enacting red-flag gun laws, designed to temporarily restrict firearm access for individuals deemed a risk to themselves or others. Proponents, led by Rep. Braxton Mitchell, argue that such laws infringe on Second Amendment rights and could lead to unjust disarmament without a criminal conviction.

Opponents, including representatives from the Montana Domestic and Sexual Violence Coalition, assert that red-flag laws are critical tools for preventing domestic violence. Notably, 21 states and the District of Columbia have adopted similar laws to address gun violence, highlighting a significant debate on the balance between public safety and individual rights in Montana, which currently does not have red-flag legislation.
