Illinois Law Changes Gun Possession Charge Names

A recent law in Illinois renames six gun possession charges in an effort to clarify the distinction between possession and actual use of firearms. Advocates believe this change could help reduce the stigma that affects job prospects and housing opportunities for those previously convicted, as many of these individuals faced charges that implied violent behavior, even when their only offense was carrying a gun without a permit.

The amendments, part of House Bill 4500, reflect ongoing concerns about the disproportionate impact of gun possession laws on Black communities in Chicago. With data indicating that arrests for illegal gun possession outnumber those for gun use by a ratio of six to one, advocates emphasize that understanding the context of these arrests is essential, particularly as they work to mitigate the negative consequences for formerly incarcerated individuals.
