AG Reinforces Self-Defense Rights Under Castle Doctrine

Attorney General Douglas Moylan asserts that self-defense is an “inherent right” under Guam’s castle doctrine, allowing homeowners to use deadly force when facing imminent threats. During a recent Q&A at the Francisco C. Chargualaf Gymnasium, he highlighted various situations, including home invasions and aggressive intruders, that legally justify such actions, stressing the importance of evaluating threats before resorting to lethal force.

Moylan clarified that while homeowners are protected under this doctrine, the law does not permit the use of deadly force solely to protect property from theft. He advised residents to consider aiming for non-lethal areas to avoid unnecessary fatalities, particularly citing scenarios where the use of force might be legally justified. His emphasis on understanding the “fact patterns” of potential confrontations aims to guide residents in exercising their rights responsibly.
