AG Won’t Prosecute Officer in Massapequa Shooting

New York Attorney General Letitia James announces her office will not prosecute a Nassau County police officer involved in the fatal shooting of 19-year-old David Clements, who confronted police with BB guns during a standoff. The investigation revealed that all weapons found at the scene were BB guns that closely resembled real firearms, complicating the legal assessment of the officer’s actions on February 2, 2024.

Clements allegedly threatened suicide and pointed the weapons at officers, leading to a lethal response. According to police, Clements had a history of mental illness and failed to comply with orders to drop his weapons. The thorough investigation considered body-worn camera footage and witness interviews, concluding that the officer’s use of deadly force was legally justified under New York law. This decision has reignited discussions on police protocols in mental health crises.
