IL Bill May Enhance Gun Restraint Powers for Police

A new bill under consideration in the Illinois State Capitol may significantly enhance law enforcement’s ability to restrain firearms during firearm restraining orders. Currently, officers face challenges due to the “clear and present danger” law, which demands proof of an immediate threat before seizing weapons. This proposed legislation aims to expand the criteria for firearm restraint to include history of abuse, substance misuse, and domestic violence patterns, according to State Rep. Bob Morgan (D-Highland Park).

Advocates argue that this update is crucial for increasing public safety as it aligns with practices adopted in many other states. The proposal is expected to be reviewed by the House gun violence prevention committee in the coming weeks, but has not yet undergone a formal vote. If passed, it could offer critical support to officers responding to urgent situations where lives are at stake.
