Lawsuit Filed Over Aurora Police Shooting Death

The family of Kilyn Lewis has filed a wrongful death lawsuit against the City of Aurora and SWAT officer Michael Dieck, following the unarmed 37-year-old’s fatal shooting last May. According to the lawsuit, Dieck’s actions were both unreasonable and in violation of multiple constitutional protections, as body-worn-camera footage reveals Lewis was shot within six seconds of officers shouting conflicting commands at him while he held a cell phone. The case challenges the prior ruling by the district attorney’s office that deemed Dieck’s use of force justified, asserting that no reasonable officer would have perceived Lewis as a threat given the circumstances.

The complaint alleges that Dieck’s failure to provide any verbal warning and the swift actions taken against Lewis constitute assault and battery leading to wrongful death. As the family seeks compensation for emotional distress and suffering, concerns are also raised about Aurora’s SWAT team involvement and prior incidents involving Dieck. The situation emphasizes ongoing scrutiny of police practices and accountability, particularly in a state with significant discussions around law enforcement conduct.
