Appeals Court Weighs Shooting Range’s Second Amendment Claim

An appeals court panel is set to determine whether Howell Township can restrict an outdoor shooting range operated by Oakland Tactical Supply, which argues that zoning laws infringe upon its Second Amendment rights. The township denied a zoning permit for the range, asserting that outdoor shooting activities are prohibited in agricultural residential areas, prompting Oakland Tactical to file a lawsuit seeking to rezone the area.

During recent hearings, attorney Pete Patterson contended that the ability to train with firearms, including long-distance shooting, is fundamental to Second Amendment protections. However, the township’s attorney argued that the zoning regulations do not prevent individual firearms training but are specific to the commercial operation of a long-distance range. The court has yet to set a timeline for its decision, which may have significant implications for the intersection of gun rights and local zoning laws.
