A Palm Beach gun owner, alongside two Second Amendment organizations, has filed a federal lawsuit aimed at overturning Florida’s ban on open carry. This law, which restricts the public carrying of firearms, puts Florida among only five states with such prohibitions, alongside Illinois, Connecticut, New York, and California. The plaintiffs argue that the ban is unconstitutional under the Second and Fourteenth Amendments, putting gun owners at risk of arrest for exercising their rights.
The lawsuit is rooted in a response to previous court rulings that upheld the state’s restrictions, which plaintiffs claim ignored historical interpretations of the Second Amendment. Luis Valdes, Florida state director for Gun Owners of America, emphasizes the personal stakes involved, stating, “We won’t stop until every Floridian can carry openly, freely, and constitutionally.” A trial date for this significant case is set for November 3, 2025, raising questions about the future of gun rights in a state known for its pro-Second Amendment rhetoric.
