Use of Virginia’s ‘Red Flag’ Gun Law Remains Low

Virginia’s ‘red flag’ gun law, designed to temporarily remove firearms from individuals deemed dangerous, is underutilized, particularly in Central Virginia. In 2024, Chesterfield County, where a recent tragic incident involved a suspect shooting his mother’s best friend, has employed the law just once, while similar jurisdictions like Henrico and Richmond mirror these concerning numbers.

Despite being introduced as a critical tool for enhancing public safety and preventing gun-related tragedies, data reveals that many localities in Virginia have not fully embraced its application. With only five significant risk orders filed in Richmond this year compared to 173 in Fairfax County, local officials cite a combination of community awareness and reliance on alternative measures as reasons for the low adoption. Those advocating for the law, however, argue for increased education and training to better utilize this legislative tool.
