Madison County State’s Attorney Tom Haine leads a coalition of 35 elected State’s Attorneys in Illinois, filing an amicus brief in the U.S. Court of Appeals arguing that the state’s ban on “assault weapons” is unconstitutional. The brief asserts that the law broadly targets commonly owned firearms without a historical precedent for such restrictions, jeopardizing the rights of law-abiding citizens across the state.
The ban, which targets firearms including AR-15-style rifles, was enacted by the Illinois legislature in January 2023. Haine emphasizes that responsible use of such firearms is often for self-defense and recreation, not violent crime, adding that this legislation contradicts the Second Amendment rights meant to protect citizens’ ability to defend their homes.
