Federal judge rules against open carry permits in RI

A federal judge has rejected a challenge to Rhode Island’s open carry permit requirements, affirming that the state’s laws do not violate the Second Amendment. U.S. District Judge William E. Smith ruled that the state’s restrictions, which require applicants to demonstrate a “proper showing of need,” are constitutional and do not infringe on individual rights, contrasting a key argument made by gun rights activists.

The ruling stems from a case filed by Michael O’Neill of the Rhode Island 2nd Amendment Coalition, who alleged his rights were violated after being denied an open carry permit. The judge noted that Rhode Island’s permitting structure operates within a legal framework that permits reasonable regulation and does not extend the rights to open carry as an entitlement, a point that could have significant implications on future firearm legislation in the state.
