The City of Austin has filed a motion to dismiss a lawsuit from Na’Kole Curry, a 24-year-old bystander who was shot in the eye by police during an incident on Sixth Street in December 2023. Curry alleges that the gunfire, which occurred when police responded to a man with a weapon, resulted in permanent blindness and severely impacted her military career.

Curry’s attorney is reviewing the city’s claims and plans to respond, as the complexities of this case highlight critical discussions around police conduct and public safety in crowded environments.
