An Alabama lawmaker has introduced a bill, HB409, aimed at prohibiting the enforcement of red flag laws in the state, which are designed to allow temporary firearm seizures for individuals deemed a risk to themselves or others. If passed, the Anti-Red Flag Gun Seizure Act would impose a $50,000 civil penalty on law enforcement agencies that enforce such laws and create a judicial relief process for those negatively affected by their enforcement.
The legislation, backed by Rep. Ernie Yarbrough, R-Trinity, aligns with a broader national trend as several states, including Oklahoma and Tennessee, have enacted similar bans since 2020. Yarbrough argues this bill protects Second Amendment rights and ensures due process, while studies indicate that red flag laws have successfully contributed to preventing suicide attempts. This new proposal has been referred to the House Judiciary Committee for consideration.
