Blue States Challenge Gun Company Immunity Laws

Democratic-led states across the U.S. are pushing to challenge the legal immunity granted to gun manufacturers by Congress in 2005, aiming to hold them accountable for gun violence. Recent legislation in 10 states, including a newly enacted law in Connecticut, enables lawsuits against gun makers if they fail to prevent firearms from getting into the hands of those banned from possession or suspected of violent intentions.

Gun rights advocates criticize these laws as unconstitutional attempts to undermine the Protection of Lawful Commerce in Arms Act (PLCAA), while proponents argue they enforce responsibility within the gun industry. Notably, past successful lawsuits, such as the $73 million settlement against Remington by Sandy Hook victims’ families, indicate a shifting legal landscape that could significantly impact the firearms sector as these new challenges proceed through the courts.
