The ordinance includes provisions banning the possession of handguns by anyone under 21 and restricting certain semiautomatic weapons for individuals aged 18 to 20, which Bailey argues violates both the U.S. Constitution and state law.
In his bid to block these regulations, Bailey teams up with Gun Owners of America and an 18-year-old plaintiff who wishes to buy a handgun from his uncle in Jackson County. The lawsuit highlights the ongoing legal contention between local and state authorities regarding gun rights, particularly after a mass shooting that left one dead and 22 injured, raising critical debates over public safety measures. Jackson County’s legislative leaders argue the restrictions are necessary for community safety, while opponents, including Bailey, maintain they infringe on constitutional rights.
