NH AG Seeks Supreme Court Review on Gun Law Challenges

New Hampshire Attorney General John Formella has filed an amicus brief with the U.S. Supreme Court, urging it to take on a case involving New Hampshire residents charged under Massachusetts gun laws. Formella argues that residents traveling through Massachusetts should not face criminal charges for carrying legally owned firearms and emphasizes that the state’s permitting process is burdensome and inapplicable to non-residents.

The case revolves around two Granite State residents, Dean Donnell Jr. and Philip Marquis, who were arrested for possessing firearms. Massachusetts’ Supreme Judicial Court ruled against them, prompting Formella to rally support from 24 other states. He contends that the Second Amendment rights should extend beyond state lines, asserting that “the Second Amendment does not end at the Massachusetts border” and challenging the notion that non-residents should be subject to different legal standards.
