SCOTUS May Address Nonviolent Felons’ Gun Rights Conflict

The U.S. Supreme Court is being urged to resolve a circuit split regarding the constitutionality of a federal law that disarms individuals with nonviolent criminal records. Steven Duarte, who was convicted for a nonviolent offense and subsequently lost his gun rights, argues that Section 922(g)(1) disproportionately impacts those who pose no public safety threat, as similar cases across multiple circuits present conflicting interpretations of this law.

Duarte’s petition is backed by a coalition of groups, including the NRA and ACLU, reflecting a broad concern over the law’s scope, which encompasses a wide range of offenses, from vandalism to financial fraud. Notably, the law has resulted in severe consequences for individuals, some of whom face permanent disarmament despite never being violent offenders—highlighting the ongoing debate surrounding Second Amendment rights and the implications for millions of Americans.
