Texans can continue to purchase firearms online and at gun shows without undergoing background checks, maintaining a significant gap in federal gun regulation. A recent ruling from a federal judge in Amarillo blocks a new Bureau of Alcohol, Tobacco, Firearms and Explosives rule aimed at closing a loophole that permits private individuals to sell guns occasionally without licenses.
While gun shows contribute to only 9% of total gun sales, experts highlight the unregulated nature of online marketplaces, where platforms like Armslist enable unlicensed transactions under the radar. During a three-year period from 2018 to 2020, an average of 1.6 million firearms ads were posted on Armslist annually, with a staggering 78% of those ads originating from states like Texas, where background checks are not mandated.
